Agreed, the league needs to police this and it shouldn't be (solely) up to the players to take a stand. However, while there's no legal basis for a lawsuit simply because a player refuses to play. That's not a breach of contract, as there is no clause in a standard player contract that says you HAVE to play. Simply, as I mentioned before, they state that if you're going to play basketball, youre gonna play for that team. If you refuse to play, they won't pay you, but that of course should go without saying. No one is going to pay unless you actually do work.

Courts have in the past, and will in the future, refused to force a player to play for a team. Just like they wouldn't force an employee to work for a company they don't want to work for. That's indentured servitude and that's a can of worms no court of law wants to deal with.

Will we see it happen that a player refuses to play? Probably not. Is it illegal or a breach of contract for them to do so? No.
I thought NBA got strong conduct provisions in player contract, don't they? If they do.. then yes it is a breach of contract..

It's a bit more tricky than that. While the NBA can tell players how to conduct themselves when representing the brand (just like your employer can), it is illegal to force someone to work for you. Period.

There will be ramifications for sure if a player refuses to play. But again, courts would be hesitant to step in and surely would not (and in fact cannot) force the player to play.

Ridiculous idea. You can tell from the article that Silver will probably never actually consider it, just saying it's creative to be polite...it's freakin crazy and would be so hard to work out.

They just need to force this guy out somehow. That's all there is to it. Whether it's immediate or through constant sanctions and pressure...they just need to get it done.

              • Also Sterling was already putting together cheap crappy rosters for years before this. This would just make the Clippers the Clippers of old. Low attendance, subpar talent, and a cheap bigoted owner who'll cut whatever costs he has to in such a situation to make sure he still benefits from owning the team.

NBA is holding press conference at 2pm tomorrow. Let's hope for $1M immediate fine and indefinite suspension!

By the way, Alex Kennedy also reporting that Clippers have lost nearly all of their sponsors.
